13 RODO (Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679). Prostym językiem opisujemy to samo w Polityce prywatności.

1. Administrator danych

Administratorem Twoich danych osobowych jest Michal Ulewicz, adres do korespondencji: skrytka pocztowa [adres skrytki zostanie uzupełniony].

Kontakt w sprawach danych osobowych: [email protected]. Nie wyznaczyliśmy inspektora ochrony danych.

2. Cele i podstawy prawne przetwarzania

  • Świadczenie usługi HereCast: konto albo konto gościa, kanały, publikacje, subskrypcje, dostarczanie wiadomości z okolicy. Podstawa: art. 6 ust. 1 lit. b RODO (wykonanie umowy, czyli regulaminu).
Podstawa: art. 6 ust. 1 lit. a RODO (Twoja zgoda, którą wyrażasz, włączając opcję „Także przy zamkniętej aplikacji”). Możesz ją cofnąć w każdej chwili, wyłączając tę opcję.
  • Bezpieczeństwo usługi, zapobieganie nadużyciom i obsługa zgłoszeń. Podstawa: art. 6 ust. 1 lit. f RODO (nasz prawnie uzasadniony interes, czyli ochrona usługi i jej użytkowników).
  • Odpowiadanie na wiadomości wysłane na nasz adres e-mail. Podstawa: art. 6 ust. 1 lit. f RODO (prawnie uzasadniony interes, czyli prowadzenie korespondencji).
  • Ustalenie, dochodzenie lub obrona roszczeń, gdy zajdzie taka potrzeba. Podstawa: art. 6 ust. 1 lit. f RODO.

3. Odbiorcy danych

Twoje dane mogą otrzymać podmioty, które pomagają nam świadczyć usługę:

  • Cloudflare, Inc.: pośredniczenie w ruchu sieciowym, szyfrowanie HTTPS i ochrona przed atakami;
  • OpenStreetMap Foundation: wyszukiwanie miejsc (Nominatim);

5. Okres przechowywania danych

  • Dane konta i treści przechowujemy do czasu ich usunięcia przez Ciebie albo usunięcia konta.
  • Zaokrągloną pozycję przechowujemy najwyżej 24 godziny albo krócej, do cofnięcia zgody.
  • Korespondencję przechowujemy przez czas potrzebny do załatwienia sprawy, a potem przez okres przedawnienia ewentualnych roszczeń.

6. Twoje prawa

Masz prawo do:

  • dostępu do swoich danych i otrzymania ich kopii (art. 15);
  • sprostowania danych (art. 16);
  • usunięcia danych (art. 17). Konto usuniesz sam w aplikacji: Profil → Usuń konto;

  • przenoszenia danych (art. 20);
  • sprzeciwu wobec przetwarzania opartego na prawnie uzasadnionym interesie (art. 21);

7. Skarga do organu nadzorczego

Jeśli uważasz, że przetwarzamy Twoje dane niezgodnie z prawem, możesz złożyć skargę do Prezesa Urzędu Ochrony Danych Osobowych (ul. Stawki 2, 00-193 Warszawa, uodo.gov.pl).

8. Czy musisz podać dane

Podanie danych jest dobrowolne. Z HereCast możesz korzystać bez konta, bez podawania e-maila i nazwiska.

9. Zautomatyzowane decyzje i profilowanie

22 RODO). Automatycznie dopasowujemy tylko publikacje do obszaru, w którym jesteś.

GDPR: how we process personal data

Last updated: October 2, 2026

This page gives the information we must provide under Article 13 of the General Data Protection Regulation (EU) 2016/679. The same is explained in plain language in the Privacy Policy.

1. Data controller

The controller of your personal data is Michal Ulewicz, postal address: PO Box [address to be added].

Contact for personal data matters: [email protected]. We have not appointed a data protection officer.

2. Purposes and legal bases

  • Providing HereCast: an account or guest account, channels, publications, subscriptions and delivery of nearby messages. Legal basis: Art. 6(1)(b) GDPR (performance of a contract, namely the Terms of Service).
  • Delivering publications while the app is closed, based on a rounded position. Legal basis: Art. 6(1)(a) GDPR (your consent, given by turning on "Also with the app closed"). You can withdraw it at any time by turning the option off.
  • Keeping the service secure, preventing abuse and handling reports. Legal basis: Art. 6(1)(f) GDPR (our legitimate interest in protecting the service and its users).
  • Answering messages sent to our email address. Legal basis: Art. 6(1)(f) GDPR (legitimate interest in handling correspondence).
  • Establishing, exercising or defending legal claims, if the need arises. Legal basis: Art. 6(1)(f) GDPR.

3. Recipients

Your data may be received by the providers that help us run the service:

  • Cloudflare, Inc.: carrying network traffic, HTTPS encryption and protection against attacks;
  • the OpenStreetMap Foundation: place search (Nominatim);
  • the map provider (currently OpenFreeMap): displaying the map.

Content you publish in public channels, and your name and profile photo, are visible to other users.

4. Transfers outside the European Economic Area

Cloudflare, Inc. is based in the United States. Data is transferred under the European Commission's adequacy decision for the EU-US Data Privacy Framework or under standard contractual clauses. The OpenStreetMap Foundation is based in the United Kingdom, for which the European Commission has issued an adequacy decision.

5. How long data is kept

  • Account data and content are kept until you delete them or delete your account.
  • The rounded position is kept for at most 24 hours, or less if you withdraw your consent.
  • Correspondence is kept as long as needed to deal with it, and then for the limitation period of any claims.

6. Your rights

You have the right to:

  • access your data and get a copy of it (Art. 15);
  • have your data corrected (Art. 16);
  • have your data erased (Art. 17). You can delete your account yourself in the app: Profile → Delete account;
  • restrict processing (Art. 18);
  • data portability (Art. 20);
  • object to processing based on legitimate interest (Art. 21);
  • withdraw consent at any time. This doesn't affect the lawfulness of processing carried out before the withdrawal.

To use these rights, write to [email protected]. We will answer without undue delay, and at the latest within one month. If you use a guest account, include the guest name shown in your profile so we can find it.

7. Complaints

If you believe we process your data unlawfully, you can lodge a complaint with the Polish supervisory authority, the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw, uodo.gov.pl), or with the supervisory authority in your own country.

8. Do you have to provide data?

Providing data is voluntary. You can use HereCast without an account, without giving an email or a name. Creating an account requires a username and an email address, and without them no account can be created. Sharing your position while the app is closed is optional.

9. Automated decisions and profiling

We don't make decisions about you based solely on automated processing that have legal effects or similarly significantly affect you (Art. 22 GDPR). The only automatic step is matching publications to the area you are in.
